1.1 Welcome to www.elvatix.com (the 'Site'), operated by Elvatix B.V., a company registered in the Netherlands under Dutch Chamber of Commerce (KVK) number 91816637, with its registered address at Fahrenheitweg 24, 6101WR Echt, the Netherlands.
1.2 This Privacy Policy explains how we handle your personal data and comply with the GDPR and applicable law when you use our Site and related platforms, applications and services (together the 'Services').
1.3 By using our Services you consent to the collection, processing and handling of your data as described herein.
2. Data controller and DPA
2.1 Elvatix B.V. is the data controller for the personal data collected through our Services.
2.2 For customers who themselves act as a data controller under the GDPR, we offer a Data Processing Agreement (DPA) on request.
3. Data we collect
3.1 User data: includes name, email address, LinkedIn ID, company details, job title, messages, interactions and contact lists.
3.2 Technical data: includes IP addresses, browser type, device information, cookies and interaction metadata.
3.3 Prospect data: includes publicly available LinkedIn profile information and data accessible through LinkedIn APIs with the user's consent.
4. How we collect data
4.1 Directly from users upon registration.
4.2 Automatically through software or plug-ins.
4.3 Through the connection to the user’s LinkedIn account and through AI models from our AI providers.
4.4 Through the use of cookies on our website.
5. Purpose of data collection
5.1 To provide and improve our Services.
5.2 To generate personalised messages.
5.3 To manage user accounts and process payments.
5.4 To analyse interactions and performance data.
5.5 To comply with legal obligations, such as fraud prevention.

6.1 Elvatix runs on SOC 2 Type II-certified, GDPR-compliant cloud infrastructure with AES-256 encryption and DDoS protection.
6.2 We implement 2FA, limit administrative access and monitor activity manually.
7. Sharing data with third parties
7.1 We do not sell or share personal data, except where necessary to provide our services.
7.2 Third parties include: our hosting and database partner, our LinkedIn connection partner, our AI providers (data is not used for training), our payment provider and our email partner. The complete and current list is set out in our Privacy Policy.
8. Data retention
8.1 Personal data is retained for as long as necessary to provide our services or to comply with legal obligations.
8.2 Data is deleted within 30 days of account termination.
9. Your rights
9.1 You have the right to access, correct or delete your personal data.
9.2 You can object to or request restriction of the processing of your data, and request data portability.
9.3 You can request deletion of your data, subject to certain conditions.
10. Cookies
10.1 Cookies are used to improve the user experience and for analytics. Functional cookies are essential; other cookies require your consent.
